Sweepstakes Rules

Titan Off-Road, LLC is the owner and operator of www.titanoff-road.net and all affiliated websites and mobile versions (“Titan Off-Road”), a company that sells off-road vehicle merchandise (“Merchandise”). We are the sponsor and promoter of sweepstakes to promote the sale of our Merchandise (“Sweepstakes”). During each Sweepstakes, we offer free Sweepstakes entries (“Entries”) that provide eligible users who purchase Merchandise or enter through an alternative method of entry (“AMOE(s)”) with an opportunity to win prize(s) described on Titan Off-Road (“Prize(s)”) by random drawing (“Drawing”), according to these Sweepstakes Rules. Entries are not available for purchase, and Entries are non-transferable. Eligibility to participate in a Sweepstakes and to redeem a Prize is contingent upon fulfilling the requirements set forth in these Sweepstakes Rules.

By obtaining Entries, you agree to these Sweepstakes Rules and our Terms of Use. These Sweepstakes Rules are intended to be read in conjunction with the Terms of Use, and the Terms of Use are incorporated herein by reference. The capitalized words used in these Sweepstakes Rules have the same meaning as assigned to those words in the Terms of Use or the Privacy Policy. Each Sweepstakes and your participation therein are subject to all applicable federal, state, and local laws and regulations.

NO PURCHASE OR PAYMENT IS NECESSARY TO PARTICIPATE IN A SWEEPSTAKES. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR ODDS OF WINNING. WE DO NOT OFFER ANY REAL MONEY GAMING.

We reserve the right to revise these Sweepstakes Rules at any time by updating this agreement and the Last Updated date above. Whenever we amend these Sweepstakes Rules, we will notify you upon your next visit to Titan Off-Road, and you will be required to re-confirm your acceptance prior to participating in a Sweepstakes. If you do not agree to the amended Sweepstakes Rules, you are not eligible to participate in any Sweepstakes.

We are not a gambling service, we do not take or place illegal bets, and we do not recommend or encourage illegal gambling. Instead, we offer sweepstakes which do not trigger the prohibitions imposed by state and/or federal gambling laws. Gambling, whether in-person or online, is not legal in all areas. If you seek information regarding any illegal activity, you must leave Titan Off-Road immediately. You agree not to use Titan Off-Road if doing so would violate the laws of your state or country. Please consult with your local authorities or legal advisors before participating in online gaming of any kind. It is your sole and absolute responsibility to comply with all applicable laws, and you assume all risk in using Titan Off-Road. Nothing published on Titan Off-Road shall be construed as legal advice on any issue. You assume all risk and responsibility for your access to and use of Titan Off-Road in connection with illegal gambling activities, and we do not condone illegal gambling. You understand and agree that Titan Off-Road is for entertainment purposes only. We make no guarantee that Titan Off-Road is legal in your jurisdiction.

Eligibility

You may participate in a Sweepstakes if you:

Reside in the 50 United States or the District of Columbia, excluding New York and Florida;
Are at least 18 years old and the age of majority in your jurisdiction (19 in Alabama and Nebraska);
Possess a valid driver’s license (for vehicle-related prizes);
Are not on the U.S. Treasury Department’s list of Specially Designated Nationals;
Are not an employee, officer, director, or immediate family member (spouse, parents, siblings, children) of Titan Off-Road, LLC, its affiliates, subsidiaries, advertising, or promotion agencies, or living in the same household as any such individuals.
Are able to provide proof of citizenship.

Each Sweepstakes is void where prohibited by law. Sweepstakes are not sponsored, endorsed, or administered by any social media platform, including but not limited to Instagram, Facebook, or X.

Sweepstakes Period

Each Sweepstakes will conclude when a cash reserve (e.g., a merchandise sales goal) is reached, as specified on www.titanoff-road.net, or on the maximum end date and time stated on www.titanoff-road.net (the “Sweepstakes Period”), whichever occurs first. Progress toward the cash reserve will be updated weekly on www.titanoff-road.net. Our servers are the official time-keeping device for each Sweepstakes Period. We reserve the right to cancel, pause, modify, or suspend any part of or all of a Sweepstakes, including the dates of the Sweepstakes Period, with notice posted on www.titanoff-road.net. Reasons for such actions may include, but are not limited to, events or circumstances outside of our reasonable control. Any event or circumstance impairing the proper functioning or integrity of a Sweepstakes will be determined by Titan Off-Road, and any corrective action (to the extent necessary) will be determined and taken by Titan Off-Road in its sole discretion.

Entries

If you are eligible to enter a Sweepstakes, have purchased Merchandise, and have agreed to these Sweepstakes Rules, we will automatically provide you with one (1) Entry for every $1 spent on Merchandise at www.titanoff-road.net. Only Merchandise purchases (excluding taxes, shipping, or gift cards) made during the Sweepstakes Period qualify. Entries are automatically generated upon purchase completion.

If you are eligible and have agreed to these Sweepstakes Rules, regardless of whether you have purchased Merchandise, you may also obtain Entries through the NO PURCHASE NECESSARY ALTERNATIVE METHOD OF ENTRY:

Mail-In Entry: On a plain 4” x 6” postcard (ENVELOPE ENTRIES WILL NOT BE ACCEPTED), legibly handprint in blue ink your first name, last name, complete address, city, state, zip code, telephone number (including area code), date of birth, e-mail address and the following unique identifier: HPQ@7Z8%91$# and send to: Titan Off-Road Giveaway, 24 Newport Dr, Forest Hill, MD 21050. Each mail-in Entry must be mailed separately in its own envelope, postmarked by the Sweepstakes Period end date (or the date the cash reserve is reached, if earlier), and received within seven (7) days thereafter. Limit one (1) free Mail-In Entry per person. NO ENVELOPES WILL BE ACCEPTED. No mechanical reproductions will be accepted.
Five (5) Entries to a Sweeps by leaving an honest review - positive or otherwise - on our google profile. Then submit a screenshot of the review to info@titanoff-road.net, your email must include first name, last name, complete address, city, state, zip code, telephone number (including area code), date of birth. Deleting a review will result in loss of entries.

All Entries, whether purchase-based or free, have an equal chance of being selected. Entries become the sole property of Titan Off-Road and will not be returned. Sweepstakes Entities are not responsible for lost, late, misdirected, illegible, postage-due, or damaged mailed Entries.

Residents of Georgia may not use Entries to enter Sweeps for cash Prizes, or any cash equivalent. Entries used by residents of Georgia on Sweeps for cash Prizes or cash equivalents will be void and non-refundable.

Prizes and Odds

Each Sweepstakes offers Prize(s) as described on www.titanoff-road.net, which may include modified off-road vehicles or other merchandise. The approximate retail value (“ARV”) of each Prize will be stated on www.titanoff-road.net at the time of promotion. Prizes are provided “as is,” and Sponsor makes no representations or warranties of any kind, express or implied, regarding any Prize, including but not limited to its condition, merchantability, or fitness for a particular purpose. For vehicle-related Prizes, modifications may void the manufacturer’s warranty or render the vehicle non-compliant with local laws (e.g., street-legality, emissions, or safety standards). The winner is solely responsible for ensuring any Prize complies with all applicable local, state, and federal laws and regulations. The winner is also responsible for all taxes (federal, state, local), title, licensing, registration, insurance, transportation costs, and any other fees associated with a Prize. Prizes are non-transferable, and no substitution or cash equivalent will be offered except at Sponsor’s sole discretion.

Odds of winning a Prize are determined by the total number of Entries submitted for the Sweepstakes. Each Entry has an equal chance of winning, regardless of whether such Entry was obtained by purchasing Merchandise or by participating in an AMOE.

Winner Selection and Notification

The winner(s) will be selected in a random Drawing from all eligible Entries received during the Sweepstakes Period, conducted on or about the date specified on www.titanoff-road.net, by Titan Off-Road or its designated representatives, whose decisions are final. Potential winner(s) will be notified by email or phone within five (5) days of the Drawing. If a potential winner cannot be contacted, does not respond within seven (7) days, or if the notification is returned as undeliverable, the potential winner forfeits the Prize, and an alternate winner may be selected at Sponsor’s discretion. To claim a Prize, the potential winner must complete and sign an Affidavit of Eligibility and Liability/Publicity Release and provide any required documentation (e.g., proof of a valid driver’s license for vehicle prizes) within ten (10) days of notification.

Taxes, Fees, and Charges

The winner is responsible for all taxes, fees, charges, and other costs associated with or incurred as a result of or in relation to the redemption of a Prize, including any shipping and handling fees prominently displayed on www.titanoff-road.net. An IRS Form 1099 will be issued to the winner for prizes valued at $600 or more, as required by law. If requested, the winner must provide a Social Security Number or Taxpayer Identification Number. Failure to provide such information may result in ineligibility to claim or receive a Prize. Sponsor is not responsible for any federal income tax withholding, unemployment contribution, workers’ compensation, Medicare/Medicaid, or any employment-related benefits.

Verification

Before you are entitled to redeem a Prize, we may require you to sign certain forms, provide verification documentation (e.g., proof of identity, residency, and a valid driver’s license for vehicle prizes), and confirm eligibility to our satisfaction. You are not entitled to a Prize, even if notified as a winner, unless and until your eligibility and the potential winning Entry have been verified by us, in our sole discretion, and you have provided all necessary forms, documentation, and information within seven (7) days of any request by us (the “Verification Period”). We reserve the right to reject screenshots and other purported evidence of winning in our sole discretion.

At any time, including after selecting a winner of a Prize (a “Winner”), we may determine the Sweepstakes, Drawing, and/or Prize to be null and void, and/or we may disqualify a Winner from receiving the Prize and/or suspend or terminate the Winner’s participation, if:

Within the Verification Period, the Winner fails to provide the requested documentation or information, sign the required forms, or confirm eligibility;
We determine that the Winner has violated these Sweepstakes Rules; or
We determine that a technical error has occurred in the Sweepstakes or Drawing.

If a Prize is no longer available for any reason after we have verified that you are eligible and have won said Prize, we will provide an option to receive an alternate Prize with a fair market value at least equal to the fair market value of the original Prize.

No Cheating or Disruptive Behavior

You will not tamper with the entry process (such as by using automated means to obtain Entries), cheat, engage in unsportsmanlike conduct or in a disruptive manner, create or attempt to create an unfair advantage over other entrants, use multiple accounts to obtain and/or submit Entries, attempt to harm the Site, a Sweepstakes, or a Drawing, violate any law, regulation, or third-party right, or otherwise undermine the operation of a Sweepstakes. Any Entries obtained or Prizes won through such activities, as determined in our sole discretion, will be null and void. If you engage in such activities or otherwise violate these Sweepstakes Rules, you will be disqualified from the Sweepstakes, and we may seek damages from you to the fullest extent of the law. Our failure to enforce any provision of these Sweepstakes Rules shall not constitute a waiver of that provision.

Publicity

Except where prohibited by law, participation in a Sweepstakes constitutes your consent to the use of your name, image, likeness, opinions, comments, photograph, voice, geographic data (i.e., hometown, U.S. state of residency), and winnings details by us or our agents for our purposes in any media, worldwide, without further payment, notice, or consideration to you.

Social Media Posts

If you post comments on our social media pages or elsewhere during a Sweepstakes that are considered bullying, spiteful, or upsetting to any user of Titan Off-Road, we may remove, request removal, or demand removal of your comments, and you will be disqualified from the Sweepstakes.

Release, Indemnification, Limitation of Liability

You hereby agree to defend, release, hold harmless, and indemnify us and our parent companies, subsidiaries, affiliated companies, officers, directors, employees, independent contractors, agents, representatives, users, media partners, advertisers, content providers, suppliers, and related parties (“Released Parties”) from and against any and all claims, costs, expenses, liabilities, and damages (including reasonable attorney fees) arising out of or related to your use of Titan Off-Road or your participation in a Sweepstakes.

To the extent permitted by law, the Released Parties are not responsible for:

Any incorrect or inaccurate information, whether caused by you, coding error, or by any of the equipment or programming associated with or utilized in a Sweepstakes.
Technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in computers, phone lines, or network hardware or software.
Unauthorized human intervention in any part of a Sweepstakes.
Payment of a Prize to any person who does not, in our sole determination, (i) meet the eligibility requirements, (ii) timely provide the required verification documentation and information, or (iii) confirm eligibility.
Any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in a Sweepstakes or receipt, use, or misuse of a Prize.

If for any reason your Entries have been erroneously deleted, lost, or otherwise destroyed or corrupted due to our fault, your sole remedy is replacement of an equivalent amount of Entries. Under no circumstances will you be permitted to obtain, and you hereby waive all rights to claim punitive, incidental, or consequential damages, or any other damages or awards, including attorneys’ fees, other than your actual out-of-pocket expenses (i.e., costs associated with participating in a Sweepstakes). You further waive all rights to have damages multiplied or increased.

SOME JURISDICTIONS DO NOT ALLOW FOR THE LIMITATIONS OR EXCLUSION OF LIABILITY DESCRIBED ABOVE, SO THE ABOVE MAY NOT APPLY TO YOU.

Arbitration

If you have a dispute with us arising out of or otherwise relating to these Sweepstakes Rules, you shall confer with us and negotiate in good faith to attempt to resolve the dispute. If you are unable to resolve the dispute with us through direct negotiations, then, except as otherwise provided herein, and subject to applicable laws, either party must submit the issue to binding arbitration in accordance with the then-existing Commercial Arbitration Rules of the American Arbitration Association. The submitting party is responsible for payment of all filing fees, or reimbursement of such fees to the respondent. Arbitral Claims shall include, but are not limited to, contract and tort claims of all kinds, and all claims based on any federal, state, or local law, statute, or regulation, excepting only claims by us for intellectual property infringement, actions for injunctions, attachment, garnishment, and other equitable relief. The arbitration shall be confidential. The arbitration shall be conducted in Harford County, Maryland, and conducted by a single arbitrator, knowledgeable in e-commerce disputes. The arbitrator shall be willing to execute an oath of neutrality. The Arbitrator shall have no authority to award any punitive or exemplary damages; certify a class action; add any parties; vary or ignore the provisions of these Sweepstakes Rules; and shall be bound by governing and applicable law. There shall be no waiver of the right to arbitration unless such waiver is provided affirmatively and in writing by the waiving party to the other party. There shall be no implied waiver of this right to arbitration. No acts, including the filing of litigation, shall be construed as a waiver or a repudiation of the right to arbitrate.

Choice of Law

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Sweepstakes Rules, or the rights and obligations of you and us in connection with a Sweepstakes, are governed by, and construed in accordance with, the laws of Maryland, without giving effect to any choice of law or conflict of law rules (whether of the State of Maryland or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Maryland.

Personal Information

Personal information collected from Entries and/or used to enter a Sweepstakes is subject to our Privacy Policy, available at www.titanoff-road.net/privacy

Amendments

We reserve the right to extend, cancel, suspend, or delay a Sweepstakes with notice posted on www.titanoff-road.net. If for any reason a Sweepstakes is not capable of running as originally planned, which shall be determined in Sponsor’s absolute discretion, including, but not limited to, insufficient Entries to select a winner, we reserve the right to extend the Sweepstakes Period or cancel the Sweepstakes temporarily or indefinitely. In the event a Sweepstakes is cancelled, suspended, or delayed, we shall not be obligated to select a winner of the applicable Prize.

Severability

If any provision of these Sweepstakes Rules is determined by a competent authority to be unlawful, invalid, or unenforceable to any extent by applicable law, such provision will be enforceable to the fullest extent permitted by applicable law, the unenforceable portion shall be deemed severed from the Rules, and such determination shall not affect the validity and enforceability of the remainder of the rules.

Entire Agreement

These Sweepstakes Rules constitute the entire agreement between Sponsor and you with respect to the Sweepstakes and supersede any prior agreement, understanding, or arrangement between you and the Sponsor, whether oral or in writing.

Winners List

To obtain a winner’s name or a copy of these Official Rules, mail a request with a stamped, self-addressed envelope to: Titan Off-Road, 24 Newport Dr, Forest Hill, MD 21050. Requests must be received within 60 days of the Sweepstakes Period end date.
